But we also represent our clients against accusations of unauthorized use of third party innovations and point out ways of avoiding intellectual property infringements (IP-Infringement).
With our patent attorneys and attorneys-at-law in the offices Hamburg, Munich and Stuttgart we advise and represent our clients in particular in patent law, utility model law, trademark and design law as well as in competition law and in copyright law, specifically related to internet and software.
We directly represent our clients before German and European offices and courts. For representation abroad we rely on a strong network of local colleagues.

Protection of innovation

To protect an innovation from imitators it is generally necessary to apply for an intellectual property right. We provide our clients with individual and case-related advice on the possibilities to protect their innovations and together we devise the legally but also commercially appropriate filing strategies.
Besides drafting applications, we also accompany all domestic and foreign application procedures up to the granting of the intellectual property right for our clients. We also take over the defense against third party attacks on intellectual property right applications and granted or registered intellectual property rights in the context of opposition and nullity procedures.
Should competitors make unauthorized use of an intellectual property right we enforce the respective intellectual property right in or out of court. Should the case be settled out of court we draft suitable agreements and licensing contracts.
Accompanying measures, such as searches in intellectual property databases, monitoring the IP activities of competitors, due-diligence evaluations and payment of annuities are also part of the services we offer.
IP-Infringement

Intellectual property researches and monitoring can help to reduce the risk of IP infringement and to adapt development processes in time to avoid infringement of third party IP rights. We perform respective analyses for our clients and if required point out possible work-arounds.
Should one of our clients be accused of infringing an intellectual property right we examine these accusations carefully and advise on possible reactions. In this context we do not limit our advise to legal aspects only, but always keep an eye on the commercial interests of our clients.
We support our clients with all court proceedings and extrajudicial procedures to refute – where possible – the infringement accusations. For out-of-court settlements we draft custom-tailored agreements and licensing contracts.
One possibility to counter an accusation of infringing an intellectual property right is to attack the validity of the respective property right. If desired we perform the necessary searches and conduct the respective administrative proceedings or court proceedings for our clients.
Our history
Intellectual property since 1876
On December 18, 1876 our firm was founded by Alexander Specht in Hamburg. Soon after, the firm was already well-known outside of Hamburg and established itself in the following years.
Since 1930 the firm keeps an office at the seat of the Patent Office, first in Berlin, since 1952 in Munich. In 2016, a further office was established in Stuttgart.
In 1970 the three partners Dr. Richard Glawe, Klaus Delfs and Dr. Walter Moll gave the firm its present name. In the meantime the firm has grown to more than ten patent attorneys and attorneys-at-law.
